Update Parkland Airport Development Corp.

On October 24, 2013, the Justice in Chambers in the Court of Queen’s Bench offered his ruling with respect to the County’s application for enforcement of the Stop Order issued against the Parkland Airport Development Corp. (PADC).  
The Courts ruled in favour of the PADC, citing jurisdiction lies with Transport Canada and therefore there was no requirement for the PADC to obtain a development permit from Parkland County.

Parkland County has been ordered to issue a haul agreement, effective immediately.

Parkland County is disappointed in this decision, as we believe there is a gap in the process and in the legislation, which prevents Council from fulfilling its obligations under section 3 of the Municipal Government Act, which is to provide good government, to provide services, facilities or other things that, in the opinion of council, are necessary or desirable for all or a part of the municipality, and  to develop and maintain safe and viable communities.

This ruling solidifies our position that revisions need to be made to Federal Aeronautics Act and the Canadian Aviation Regulations to ensure the interests of the public are served and protected, and this is best done by including local authorities in the consultation and approval process.

As Parkland County has exhausted all its avenues for attempting to resolve this matter to the satisfaction of its residents, we can only invite those who are displeased with this decision to contact the local Member of Parliament, and the Minister of Transportation.
